1.
The Promoter will provide reasonable access to properly earthed
mains electricity supply of 6.2Kw rating. (Preferably two 13-16 amp socket
outlets) to allow safe usage of the required equipment for the performance. If
in the opinion of the Discotheque/Artist(s), the power supply is
inadequate, The Discotheque/Artist may reduce the amount of equipment
accordingly, without prior consultation with the Promoter.
2. In
the event of the Promoter wishing to cancel a booking over 21 days prior
to the function the Discotheque/Artist(s) reserves the right to make an
administration charge of £10.00 or 10% (whichever the greater) of the
negotiated payment upon cancellation. The Promoter may not cancel the
Discotheque/Artist(s) within 21 day of the engagement unless full payment of
the fee balance accompanies such cancellation.
3. Whilst
the Discotheque/Artist(s) will use its best endeavors to attend the
function or provide an alternative Discotheque/Artist(s) to give
satisfactory performance, should the Discotheque/Artist(s) be prevented
from doing so for any reason outside its control (including mechanical
breakdown, equipment failure or sickness) the Discotheque/Artist(s) shall
not incur any liability for its non-appearance.
4. In
the event of the Discotheque/Artist(s) agreeing to be paid a percentage
of the admission money, the Promoter must provide the Discotheque/Artist(s),
or his representative, with a written statement of the full details of ticket
numbers, admission prices and numbers of patrons, and provide full facilities
for the checking of the same.
5. A
licence for the performance of recorded music are only required at public
events. (In most cases private parties;
wedding receptions etc, do not require such a licence). However, it is the Promoter's responsibility to ascertain
weather or not such licence is required, and the responsibility for taking out such
licence is entirely in the hands of the Promoter.
Should the Discotheque/Artist(s) be prevented from performing by any
failure of Promoter to obtain the appropriate
licence or permission for the performance or should the
performance be cancelled for any reason other than which is mentioned in clause
3 above, then the provisions relating to cancellation as set out in clause 2
above shall apply.
6. Where
the Discotheques/Artist(s) services are booked on a residency or regular
basis at a place of entertainment. Christmas Eve, Christmas Day, Boxing Day and
New Years Eve are subject to individual arrangements to be agreed by both sides
by 1st November preceding.

The Promoter should make sure that parking spaces will be
available for the Discotheque/Artist(s) vehicle(s) to the nearest
entrance/exit to the place of the function. The vehicle(s) then cannot be
separated or moved for security reasons during the duration of the event. The Promoter
will be responsible for any fines put upon the vehicle(s) during the event i.e.
clamping etc. The Promoter will allow the Discotheque/Artist(s)
sufficient time for his/her equipment to be set up and at the completion of the
performance, sufficient time to dismantle and remove the equipment from the
venue. If at the request or instruction of the Promoter the
Discotheque/Artist(s) and/or recorded music is to left at the venue, the Promoter
will be liable for any loss or damage however caused to the equipment or
recorded music during such times as it is at the venue.
8. Should
the equipment be left at the venue as in clause 7 above, and should
circumstances arise which prevents the Discotheque/Artist(s) obtaining
access in order to effect removal at a mutually agreed time then the Promoter
will be liable for additional expenses to cover further appointments for removal
of the said equipment. Should the duration
arise where the Discotheque/Artist(s) requires the equipment for other bookings
and is prevented from carrying out these additional booking due to inability to
gain access to the venue then the Promoter will be liable for loss of
earnings thus incurred.
9. The
Promoter will provide adequate supervision of all the guests and or
customers and or staff at the venue, and will be liable for any damage to the Discotheque/Artist(s)
equipment caused by said guests, customers or staff.
10. The Promoter
warrants that he/she is entitled to use the venue for the purpose of the event
and performance.
11. Where possible,
in places of public entertainment the Promoter will provide a room where
the Disc Jockey/Artist(s) and his/her assistants may rest/change prior
to, between or after his/her performance.
12. The Disc
Jockey/Artist(s) and his/her assistants will not be expected to be on stage
without adequate refreshments for any period during the function.
13. The Disc
Jockey/Artist(s) and his/her assistant will conduct themselves in a sober
and proper manner and will respond to the promoter(s) request as to the volume,
situation of equipment and any other reasonable request.
14. The Promoter
shall permit the Discotheque/Artist(s) to display DJ Services Group
advertising material only at the venue.
15. The Discotheque,
the Disc Jockey or, the Artist(s) and their assistants shall be in
no way liable for any breach of Laws, Bye-Laws and conditions under which any
premises or property are leased, hired or entrusted to the Promoter.
